These terms govern use of the Harpz Nexus website and services. A project proposal, order form or statement of work may include additional terms; if there is a conflict, the signed project document applies to that project.
Services and scope
Harpz Nexus provides AI Receptionist, customer communication automation and related digital systems. Scope, timing, fees, included revisions, dependencies and deliverables are confirmed in writing before paid production work begins. Website descriptions and “starting from” prices are indicative and are not binding quotations.
Client responsibilities
You must provide accurate business information, timely approvals, lawful content, necessary account access and rights to materials supplied. You remain responsible for business decisions, regulated obligations and final approval of business information, escalation rules and customer-facing workflows.
AI and automation limitations
AI can produce incorrect, incomplete or unexpected results. Automated systems require approved knowledge, escalation rules, fallback behaviour, monitoring and periodic review. They must not be relied upon for emergencies or as a substitute for medical, legal, financial or other regulated professional advice. No system can guarantee uninterrupted service, leads, sales, rankings or revenue.
Voice, messaging and recording
Clients deploying voice, messaging, recording, transcription or marketing workflows must comply with applicable consent, privacy, telecommunications, anti-spam and consumer laws in each relevant location. Appropriate AI and recording disclosures should be configured where required. Harpz Nexus may refuse or stop a workflow that appears deceptive, unlawful or unsafe.
Integrations and third-party providers
Production services may depend on telephony, AI, hosting, messaging, calendar, CRM, job management, payment and automation providers. Specific provider capabilities, language support, usage, outages, approvals and policy changes are outside Harpz Nexus control. Integrations are treated as live only after the relevant connection has been verified for the agreed project.
Fees, subscriptions and taxes
Fees, currency, payment schedule, setup charges if any, third-party usage and applicable taxes are shown in the project agreement, invoice or approved checkout. The public “starting from A$79” statement is an entry price indication only; exact commercial scope is confirmed before production setup.
Intellectual property
Each party retains its pre-existing materials. Subject to full payment, ownership or licence rights for custom deliverables are as stated in the project agreement. Third-party software, fonts, assets, platforms and open-source components remain subject to their own licences.
Availability and fallback
Services may depend on third-party infrastructure. Production workflows should define fallback behaviour for service interruptions, but uninterrupted availability cannot be guaranteed. Harpz Nexus may modify a workflow where reasonably necessary for security, compliance or provider compatibility, subject to the applicable agreement.
Acceptable use
You must not use our services for deception, unlawful surveillance, spam, rights infringement, malicious activity, discrimination, harassment or other illegal or harmful conduct.
Liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss. Any limitation in a project agreement applies subject to rights and guarantees that cannot lawfully be excluded, including applicable Australian Consumer Law rights.
Termination
Either party may terminate according to the applicable project or subscription agreement. We may suspend service for non-payment, security risk, unlawful use or material breach. Outstanding obligations and terms intended to survive termination remain effective.
Governing law
These terms are governed by the laws of Victoria, Australia, subject to any mandatory rights that apply in another relevant jurisdiction.
